Terms of Service

Welcome to FoliagePal. These Terms of Service ("Terms") are entered into between you and Nanjing Hongliu Intelligent Technology Co., Ltd. ("we," "us," or "our") regarding your use of FoliagePal and related services.

By using FoliagePal, you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy. If you do not agree, please stop using FoliagePal.

1. Service Description

FoliagePal provides plant identification, pest and disease diagnosis, AI care recommendations, AI assistant features, care plans, reminders, cloud sync, history, community interactions, VIP subscriptions, and related services.

FoliagePal provides different features depending on user region, download channel, and platform, including login methods, payment channels, advertising services, push notification services, AI services, and available content. Some features, subscription plans, or third-party services may only be available in certain countries or regions.

2. Accounts and Registration

You may register or log in using phone number, email, Apple, Google, WeChat, or other supported methods, depending on your region and platform.

You must provide true, accurate, and complete information, and you are responsible for keeping your account and login credentials secure. You are responsible for losses caused by your failure to safeguard your account.

If we find that an account is involved in unlawful activity, fraud, abuse, attacks, infringement of others' rights, circumvention of paid restrictions, or violation of these Terms, we may restrict, suspend, or terminate the account.

3. Guest Mode and Free Users

FoliagePal may provide guest mode and free user mode. In guest mode, some data may only be stored locally or may not be fully synced to the cloud. Changing devices, uninstalling the app, or clearing data may result in loss of related content.

Free users may use basic features, but some advanced features, identification quotas, AI conversation quotas, pest and disease diagnosis, advanced care plans, cloud sync, history, or ad-free benefits may be available only to VIP users.

4. AI Content and Plant Care Recommendations

Plant identification results, pest and disease diagnosis, care guides, AI assistant replies, and other AI-generated content provided by FoliagePal are for reference only and may be inaccurate, incomplete, delayed, or unsuitable for your specific circumstances.

You should make your own decisions based on plant species, climate, soil, light, temperature, humidity, pesticide instructions, and professional advice. For toxic plants, pesticide use, child or pet safety, commercial planting, or other high-risk matters, consult a professional and follow local laws and product label instructions.

We are not liable beyond the extent required by law for plant damage, economic losses, or other consequences caused by reliance on AI content or care recommendations.

5. User Content

You retain your lawful rights in content you upload, publish, or create, including photos, posts, comments, private messages, and care records.

You grant us a worldwide, non-exclusive, royalty-free license, sublicensable to service providers, to use, copy, store, display, transmit, distribute, moderate, promote, and make necessary format adjustments to your user content solely for operating, displaying, storing, distributing, promoting, reviewing, improving FoliagePal, and fulfilling security and compliance purposes.

After you delete content or close your account, we will stop publicly displaying the relevant content, except where retention is required by law, backup systems, security audits, dispute resolution, or technical limitations.

6. Community Rules

You may not post, send, upload, or distribute content that:

• Is unlawful, fraudulent, infringing, harassing, threatening, hateful, pornographic, violent, discriminatory, or otherwise objectionable
• Infringes another person's privacy, portrait rights, reputation, intellectual property, or other lawful rights
• Contains another person's phone number, address, identity document, payment information, chat records, or other personal information
• Contains spam, malicious links, viruses, scripts, crawlers, or automated abuse
• Impersonates others, makes false claims, induces transactions, or circumvents platform rules
• Abuses AI features to generate unlawful, harmful, or infringing content

We may conduct manual or automated moderation and may delete content, limit visibility, mute accounts, restrict features, suspend accounts, or terminate accounts. You may report violations through in-app reporting tools or by contacting support@foliagepal.com.

7. VIP Subscriptions and Payments

FoliagePal provides VIP subscription services. Specific benefits, prices, billing periods, and promotions are shown on the purchase page. VIP subscriptions may include ad-free use, unlimited plant identification, unlimited AI conversations, unlimited pest and disease diagnosis, advanced care plans, cloud sync, history, and other benefits.

FoliagePal offers monthly, quarterly, and annual auto-renewing subscriptions. Subscriptions automatically renew at the end of each billing period unless canceled before the deadline required by the applicable platform.

iOS purchases are processed by Apple App Store, and payment, renewal, cancellation, and refunds are handled by Apple.

Overseas Android purchases are processed by Google Play Billing, and payment, renewal, cancellation, and refunds are handled by Google Play.

Users in Mainland China may purchase through WeChat Pay, Alipay, or Apple In-App Purchase, subject to the payment page and channel rules.

Deleting the app, stopping use of FoliagePal, or deleting your account usually does not automatically cancel platform subscriptions. You must cancel auto-renewal through Apple ID, Google Play, WeChat Pay, Alipay, or the applicable purchase channel.

After VIP expires, your account will revert to free user mode and VIP privileges will no longer be available.

8. Advertising

FoliagePal may display third-party ads. The Mainland China version may use Pangle, and the overseas version may use Google AdMob. You can manage ad personalization in your device system settings.

VIP users do not see in-app ads or task ad pages. Service notifications, system messages, community content, subscription status notices, and non-advertising operational information are not ads.

We are not responsible for third-party ad content, third-party websites, or third-party services.

9. Intellectual Property

FoliagePal and related software, interface designs, trademarks, logos, text, images, model invocation flows, database structures, and other content, excluding user content and third-party content, are owned by us or relevant rights holders.

Without written permission from us or the rights holders, you may not copy, modify, distribute, sell, rent, reverse engineer, decompile, scrape, mirror, or otherwise exploit FoliagePal or related content.

We may use feedback, suggestions, or improvement ideas you submit to improve our products and services without paying you compensation.

10. Prohibited Conduct

You may not:

• Use FoliagePal in violation of laws, regulations, or platform rules
• Attack, interfere with, disrupt, or bypass FoliagePal security mechanisms
• Use scripts, crawlers, plug-ins, automated tools, or abnormal methods to access the service
• Crack, bypass, abuse, or circumvent subscriptions, ads, identification quotas, or AI call limits
• Upload malicious code, viruses, or other harmful content
• Infringe another person's intellectual property, privacy, or other lawful rights
• Use FoliagePal for fraud, spam, illegal transactions, or other improper conduct

11. Service Changes, Suspension, and Termination

We may update, suspend, restrict, or terminate part of the service for business, technical, legal, or security reasons. For material changes, we will make reasonable efforts to notify you through in-app notices, website announcements, or other methods.

You may stop using FoliagePal at any time, or request account deletion through "Me - Settings - Privacy Settings." Account deletion enters a 30-day grace period. After the grace period expires, we will delete or anonymize relevant data in accordance with the Privacy Policy.

12. Disclaimer

FoliagePal is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we do not guarantee that the service will be completely accurate, continuous, timely, secure, error-free, or meet all of your expectations.

AI identification, diagnosis, and care recommendations are for reference only and do not constitute professional agricultural, horticultural, medical, legal, safety, or commercial planting advice.

13. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential damages arising from use of or inability to use FoliagePal.

To the maximum extent permitted by law, our total liability to you will not exceed the amount you actually paid for FoliagePal in the 12 months before the claim arose.

The disclaimers and liability limitations in these Terms do not apply to liabilities that cannot be excluded or limited by law, including liability caused by intentional misconduct or gross negligence, or non-excludable rights under applicable consumer protection laws.

15. Changes to These Terms

We may update these Terms from time to time. For material changes, we will notify you through in-app notices, website announcements, email, or other appropriate methods. If you continue to use FoliagePal after the changes take effect, you accept the updated Terms.

16. Governing Law and Dispute Resolution

These Terms and dispute resolution do not exclude mandatory consumer protection rights under the laws of your place of residence.

To the extent permitted by law, disputes relating to these Terms or FoliagePal should first be resolved through friendly negotiation. If negotiation fails, disputes may be submitted to the competent court where the operator is located, or another competent court as required by applicable law.
